This May Not Be The Best Chanukah for Shaya Boymelgreen

BoymelgreenNew York apartment building developer Shaya Boymelgreen has had a rough year. (Click here for further information.) In the latest chapter of his real estate dealings, the developer sold his 40-year lease on 752 Pacific Street in Brooklyn to Forest City Ratner without the owner’s knowledge. Forest City needs to raze the building so it can construct its project on the Atlantic rail yards. (Click here for more information on this development project from this site. In May, the New York state appeals court ruled that Harry Weinstein, the owner of the Pacific Street building, could evict Boymelgreen. The court also found that Forest City was given illegal assignment to Weinstein’s properties. According to Weinstein, Boymelgreen hasn’t paid rent since June.

This week, the New York State Court of Appeals will decide if the eminent domain doctrine allows the Empire State Development Corp. to confiscate land for Forest City’s Atlantic Yards project.
